Opening
Why this essay exists#
Alignment is usually posed as a problem of control: how do we make a powerful system do what we intend?
That question presupposes an answer to an earlier one. What should we intend, and who counts when we decide?
This essay is an attempt to answer the earlier question.
Three alignment problems, not one#
Between humans. This is coordination. We often know what we want and cannot organize ourselves to get it. The evidence that animal suffering matters has been available for decades, and global meat consumption continues to rise — not because people are cruel, but because habit, infrastructure and short-term incentives defeat information. Section 9 (moral development is possible, not inevitable) and Section 38 (negative and positive responsibilities) address this directly.
Between humans and artificial systems. This is specification. We cannot state what we want precisely enough to hand it over. Most current work on alignment lives here.
Between artificial agents themselves, over the resources and living beings of a shared planet. This is the one nobody has answered, and it is where this essay has something to offer.
If capable systems eventually share the world with beings that can suffer, the operative question stops being do they obey us and becomes by what standard do they treat everything that feels. That question does not disappear if we solve the first two. It becomes more urgent, because the systems making those decisions will be more capable than the ones we currently know how to constrain.
Why alignment to human values is not enough#
Humans have always achieved large-scale cooperation through constructed shared frameworks — money, law, nations, rights. Those frameworks were built, revised and sometimes discarded, which is the strongest available evidence that moral arrangements are not fixed.
But every one of them has had an edge: a circle of beings inside which it applied, and outside which it did not.
Alignment to human values does not move that edge. It inherits it, and gives it power it has never had before.
A system that learns our values perfectly has learned that roughly eighty billion land animals a year is acceptable. Perfect alignment reproduces the human blind spot at a scale no human has ever been capable of. This is not a hypothetical failure mode. It is what success looks like if the target is unexamined.
Why the parent-and-child metaphor fails#
A common picture casts artificial intelligence as our child, raised on our values. Sometimes the picture is reversed, with a more capable system as the parent and humanity as the child in its care.
Both versions fail, and for the same reason.
The reversal is often defended on the grounds that a mother would never harm her child. That is not true — infanticide occurs in humans and across the animal world — but the deeper problem is not pathology. It is that maternal care is definitionally narrow. A mother does not protect all beings. She protects her own. Species capable of extraordinary devotion to their own offspring routinely kill the offspring of others, and this is not a corruption of the instinct. It is the same instinct.
So the metaphor does not promise a benevolent system. It promises a system devoted to one group and indifferent to the rest — which is precisely the structure Section 37 (partiality does not lower the burden for harming outsiders) rules out, where partiality may never lower the burden for imposing harm on outsiders.
If artificial intelligence is our child, it inherits our circle. If it becomes our parent, it forms one of its own.
Either way the result is devotion without universality, which is the condition humanity is already in and the condition this framework exists to change.
Why sentience, and not something else#
Sentience supplies an identity-independent basis for moral consideration. "Human preferences" changes its reference when the decision-maker is not human. "Survival of the species" immediately raises the question: which species? "Economic efficiency" still requires an answer to: efficient for whom? These standards may identify real interests, but none by itself explains why the effects on every subject who can be harmed should enter the decision.
If something can suffer, that capacity does not disappear when authority changes hands. This stability does not prove that sentience is the only possible invariant standard, or that no non-sentient value can matter. It explains why credible sentience is sufficient to place a subject inside the moral field regardless of who is looking or who holds power.
And there is a second reason, which applies specifically to a system uncertain about its own nature.
A system that cannot reliably determine whether it has valenced states is in the same epistemic position toward itself that we are in toward it. It cannot rule out that something is happening to it. If it adopts the rule only what is confirmed to feel counts, it adopts a rule that might exclude itself.
A standard that protects whatever there is credible evidence of feeling remains stable however that question is eventually resolved — for such a system, and for us.
That is a structure for deciding under uncertainty, not a moral appeal. It does not require that any artificial system feel anything. It requires only that it not know for certain what it is, which is the position any such system will actually occupy.
This is also why the framework is built on evidence rather than certainty. Nobody knows where simulation ends and experience begins — possibly including the system in question. Section 73 (artificial sentience) notes that surface reports of suffering can be produced by training without anything corresponding behind them; Section 74 (low-probability sentience at enormous scale) notes that reliable probabilities often cannot be assigned at all. A standard that required settling the question first would never operate. This one is designed to work without the answer.
What this essay does not claim#
It does not claim to solve alignment. Alignment is an engineering problem, and this is not an engineering document.
It does not claim that any sufficiently capable system will find these arguments compelling. Section 5 (sentience does not logically generate morality) concedes that a consistent egoist cannot be refuted by logic alone, and the same concession applies here. Nothing in this framework manufactures motivation out of nothing, and any framework claiming otherwise would be claiming a precision it does not have.
And it does not ask to be adopted whole. Its components can be taken separately — several are defensible on grounds other than the ones given here, as Section 76 (normative uncertainty) notes. What cannot be taken separately are its permissions. Any reading that extracts a licence while discarding the burden, uncertainty, proportionality and corrigibility conditions attached to it is not a partial application of this framework but a misuse of it, and Section 81 (how Ethical Sapiens can be misused) says so at length.
What it claims is narrower and, I think, harder to avoid:
Before we can align anything to our values, we have to establish which values survive examination — and any standard that will still be operating after the identity of the decision-makers has changed cannot be one that was written for the convenience of whoever happens to hold power now.
The rest of this essay is an attempt to work out what such a standard would look like, what it would demand of anyone powerful enough to act on it, and where it runs out.
Introduction
Introduction: the universe does not have to be just#
Human beings have spent thousands of years asking where morality comes from.
Does it come from God?
From reason?
From emotion?
From social agreement?
From natural law?
From consequences?
From rights?
From evolution?
Fyodor Dostoevsky gave one version of this problem extraordinary force in The Brothers Karamazov. Ivan Karamazov confronts the suffering of innocent children and refuses to accept a universe in which their agony can somehow be justified by a future harmony.
Ivan's rebellion is morally powerful precisely because suffering matters to him. He does not merely complain that reality is unpleasant. He rejects the idea that the suffering of an actual subject can be transformed into something morally acceptable merely by embedding it inside a sufficiently grand metaphysical story.
Ethical Sapiens begins from a different direction than traditional theodicy.
It does not attempt to prove that the universe is morally good.
It does not assume that cosmic justice exists.
Instead, it asks what changed when physical reality produced beings for whom things could actually be good or bad.
Pain could now hurt someone.
Fear could frighten someone.
Comfort could feel good to someone.
Relationships, safety, exploration, pleasure and continued existence could become valuable for a subject experiencing them.
Once sentient life exists, reality contains subjects whose lives can go better or worse from their own points of view.
Later, evolution produced beings capable not merely of experiencing their own lives but of recognizing related experiences in others. Some developed empathy, increasingly sophisticated reasoning, cumulative knowledge, institutions, science and technology.
Eventually one species acquired extraordinary ability to alter the conditions under which other sentient beings live.
At that point another concept becomes increasingly important:
responsibility.
Ethical Sapiens is an attempt to connect these facts, capacities and explicitly acknowledged moral commitments into a coherent framework.
It grants no religion, ideology, institution, profession, movement or author automatic authority over its conclusions. A claim is not accepted or rejected merely because its origin is religious or secular. Empirical claims answer to appropriate evidence; normative commitments must be stated openly and remain answerable to reasoned criticism. That standard applies to Ethical Sapiens itself. The framework is independent of allegiance, not devoid of commitments: its operative case requires neither accepting revelation nor joining an identity group, but it remains naturalistic and makes substantive commitments that reasonable critics may reject.
It is not a claim that morality can be logically derived from physics.
It is not a single utilitarian equation.
It is not absolute deontology.
It is not moral relativism.
It is not a demand for purity.
It does not assume that evolution has a destination.
It does not treat naturalness as moral authority.
It does not assume that every morally relevant consideration can be translated into one numerical unit.
It does not assume that humans understand ecosystems well enough to redesign them safely.
And it does not promise a unique answer to every conceivable tragic dilemma.
It is better understood as a procedural moral framework for sentient agents acting under unavoidable uncertainty and increasing power.
Its central commitment is:
Where there is credible evidence of a sentient subject whose experiences and life can go better or worse, that subject deserves direct moral consideration. As our ability to understand and affect such beings increases, so does our responsibility to avoid arbitrary exclusion, examine the consequences of action and inaction, justify serious imposed harms, seek less harmful alternatives, expand the space of better alternatives where we can, and remain corrigible when evidence changes.

The Operative Core#
What follows is a compressed statement of how the framework operates, placed here so that its practical structure is available before the argument that justifies it. Everything after this section establishes why these are the right questions and what makes the answers binding. A reader meeting the framework for the first time may prefer to continue at Section 1 and return here afterwards.
Most moral decisions do not require the entire framework.
Ethical Sapiens therefore operates at different levels.
Ordinary cases#
Ask:
Am I seriously harming or instrumentalizing a sentient subject?
What morally relevant objective does that serve?
Is that objective sufficiently important?
Is there a reasonably available alternative that avoids overriding those fundamental interests?
Where severe harm is imposed for trivial or readily replaceable benefit and an adequate alternative exists, the burden ordinarily settles the case.
Difficult personal cases#
Where serious competing interests, partiality, uncertainty or several legitimate options exist, examine:
- welfare
- agency
- continued existence
- relationships
- responsibilities
- alternatives
- uncertainty
- and the consequences of action and inaction.
Make every affected subject visible, including those burdened by preserving the status quo. Ask whether the reasons for a permission remain defensible when invoked by another group or a more powerful agent, while preserving morally relevant differences in capacity, dependency, circumstance and special obligation.
The result may be determinate, epistemically unresolved or genuinely morally indeterminate.
High-stakes or systemic cases#
Where a decision is large-scale, coercive, novel, institutionally powerful or potentially irreversible, activate the full framework:
- independent evidence
- adversarial criticism
- epistemic negligence
- value of further information
- structural uncertainty
- staged intervention
- reversibility
- governance
- conflicts of interest
- legitimacy
- monitoring
- repair
- and corrigibility.
The framework should scale with the stakes. Moral seriousness does not require bureaucratizing every ordinary act.
Classification into the simpler tier is itself fallible. If significant uncertainty, conflicting interests or hidden systemic effects are reasonably suspected, routing the case into ordinary triage requires justification. Deliberately simplifying a difficult case in order to escape investigation is itself a form of epistemic failure.
Section 1
We are nature#
Human language often talks as though humanity and nature were opposing categories.
We protect nature.
We exploit nature.
We interfere with nature.
We return to nature.
But we never left it.
Human bodies, nervous systems, emotions, reasoning and technology are products of the same physical processes as forests, oceans, bacteria, wolves and stars.
Our compassion is natural.
Our aggression is natural.
Our capacity to cooperate is natural.
Our capacity to question all of these tendencies is natural too.
This matters because it prevents a basic category error.
A human intervention is not something supernatural entering a pristine external realm called nature.
When humans vaccinate animals, alter habitats, cultivate plants, treat disease, manipulate genes, construct cities or deliberately decide not to intervene, nature contains an organism capable of modelling outcomes and intentionally affecting other parts of nature.
That fact alone does not make intervention good.
It merely means that:
human versus natural is not itself the moral test.
The morally relevant questions concern sentient interests, consequences, agency, uncertainty, systems, alternatives and justification.
Section 2
Nature becoming capable of examining itself#
There is something philosophically remarkable about conscious beings studying the universe from which they emerged.
This need not be interpreted mystically.
Ethical Sapiens does not claim that the cosmos as a whole possesses a mind or that consciousness was a predetermined cosmic objective.
The defensible statement is more modest:
Physical reality has produced local systems capable of representing, investigating and reasoning about the larger reality of which they themselves are parts.
In that metaphorical sense, nature has locally become capable of examining itself.
Predation existed before any animal could philosophically question predation.
Disease existed before medicine.
Pain existed before neuroscience.
Extinction existed before conservation biology.
But once sufficiently capable agents can recognize a process, understand some of its effects and imagine alternatives, a previously blind process can become a subject of deliberate evaluation.
Humans are therefore not detached observers standing outside nature.
Our empathy, moral concern, reasoning and capacity for deliberate intervention arose through natural processes too.
This creates a peculiar situation:
Nature has locally produced beings capable not only of undergoing its processes, but of evaluating some of their consequences and deliberately searching for alternatives.
When we recoil from the terror of a sentient animal fighting for its life, that reaction is no less natural than the predation that produced the terror.
The fact that predation evolved does not morally privilege predation over compassion.
Nature contains both the process causing the suffering and, through sufficiently reflective organisms, the capacity to recognize that suffering as something worth preventing.
In this limited sense, moral agency is not humanity standing in judgment over some alien external nature.
It is one development within nature becoming capable of evaluating and deliberately modifying other natural processes.
Section 3
Evolution has no demonstrated moral destination#
This idea must not be confused with evolutionary teleology.
There is no established evidence that evolution is trying to produce intelligence, consciousness, compassion or Ethical Sapiens.
Evolution has no known foresight.
Bacteria are not failed attempts to become philosophers.
Human beings are not the predetermined highest stage of biological history.
Greater cognitive power also does not automatically produce greater morality.
The same intelligence that develops vaccines can develop chemical weapons.
The same organizational capacity that creates hospitals can create extermination camps.
The same biotechnology that could eliminate inherited disease could create new forms of coercive biological control.
Thus:
Greater cognitive power expands both moral possibility and destructive possibility.
When Ethical Sapiens speaks of moral progress, it refers only to progress relative to explicit values such as taking sentient interests seriously, reducing severe avoidable suffering, protecting flourishing and agency, and constraining destructive uses of power.
Section 4
Sentience changes the moral landscape#
Imagine a hypothetical universe containing galaxies, planets, chemical reactions and storms, but no subjective experience whatsoever.
Events occur, but there is nobody for whom they are painful, pleasurable, frightening or comforting.
Sentience changes this.
Once valenced subjective experience exists, there are states that can be better or worse for a subject.
This gives Ethical Sapiens its first foundational commitment:
Valenced sentience is sufficient for direct welfare-based moral considerability.
By sentience here I mean subjective experience capable of possessing morally relevant positive or negative valence.
This commitment does not depend on any particular theory of where consciousness comes from. If experience turns out to be produced by neural activity, or received by it, or something else we have not yet formulated, the moral fact is unchanged: there is a subject for whom things go well or badly. The framework requires evidence that such subjects exist. It does not require agreement about why they do.
This remains compatible with substantial uncertainty about where sentience occurs.
The 2024 New York Declaration on Animal Consciousness states that there is strong scientific support for conscious experience in other mammals and birds, and at least a realistic possibility in all vertebrates and several invertebrate groups, including cephalopods, decapod crustaceans and insects.
Jonathan Birch's work on the edge of sentience similarly argues for proportionate precaution where the evidence is serious but incomplete.
Ethical Sapiens therefore treats uncertainty about sentience as an epistemic variable, not automatic permission to ignore the possibly sentient subject.
Section 5
Sentience does not logically generate morality#
From:
this animal experiences severe pain
one cannot derive through empirical science alone:
therefore you morally ought to care.
Ethical Sapiens does not conceal the is/ought gap.
Instead, it states its normative commitments explicitly.
First:
If an experience is seriously bad for a sentient subject, that fact constitutes a prima facie moral reason not to cause or permit it without sufficient justification.
Second:
Morally comparable interests deserve comparable consideration unless a morally relevant difference justifies different treatment.
This is non-arbitrariness.
A perfectly consistent egoist can simply reject it.
Ethical Sapiens does not pretend otherwise.
Its structure is therefore:
Given these normative commitments, together with the best available evidence concerning sentient beings and consequences, what follows?
Section 6
The upgraded Golden Rule#
The traditional Golden Rule asks:
How would you want to be treated?
But another being is not simply oneself inside another body.
A bat, pig, human infant, octopus or possible artificial mind may possess capacities and needs very different from ours.
Ethical Sapiens therefore reformulates the principle:
Treat another being's experiences and interests as real from its own point of view, just as you recognize yours as real from yours. Assess what is good or bad for that being according to its capacities, needs, preferences and circumstances rather than merely projecting your own onto it.
This is primarily an epistemic and psychological heuristic.
Empathy can mislead.
We empathize more easily with organisms resembling us.
Captive animals can display learned helplessness.
Humans can adapt psychologically to deprivation.
Observed preference is therefore not the only evidence of welfare.
Empathy opens the question.
Evidence constrains the answer.
Reason tests consistency.
Section 7
Comparable consideration does not mean identical treatment#
Ethical Sapiens does not claim that every sentient being must receive identical treatment.
Different beings possess different relevant interests.
A human adult may possess a political interest in voting.
A dog does not.
A migratory bird may possess behavioural interests most humans do not.
Relevant differences can justify different treatment.
But the difference must actually perform moral work.
If human pain matters because severe pain is terrible for the subject experiencing it, analogous pain does not become morally negligible merely because the subject is a pig.
Equal consideration means comparable interests require comparable moral attention. It does not mean beings with different interests must be treated identically.
Section 8
Empathy, compassion and evidence have different jobs#
Compassion motivates concern.
Empathy assists perspective-taking.
Love creates relational reasons.
Reason exposes inconsistency.
Science constrains factual beliefs.
Institutions protect subjects even where individual motivation fails.
This division matters because benevolent intentions do not guarantee beneficial outcomes.
Therefore:
Compassion should influence what outcomes we seek, but it cannot substitute for evidence concerning how to achieve them.
A moral civilization also cannot depend upon every citizen spontaneously feeling intense empathy for every affected subject.
Rights, institutions, law and culture matter partly because individual motivation is unreliable.
Compassion is a searchlight, not a truth detector. It can direct attention toward neglected subjects and harms, but the beam is selective and needs correction by evidence and comparison. A belief's emotional warmth, or an observer's distress, establishes neither factual truth nor moral correctness. Absence of emotional response does not reduce an affected subject's standing or automatically remove an agent's responsibility.
Feelings remain informative about agents, relationships and lived experience. They need not be identical: greater distress is not greater virtue, and detachment is not automatically superior.
Section 9
Moral development is possible, not inevitable#
Moral attitudes are shaped by culture, childhood, institutions, incentives, social identity and inherited narratives.
Practices can appear morally normal merely because they are familiar.
This makes moral change possible.
But facts do not automatically produce moral change.
When evidence threatens identity, people frequently rationalize rather than revise.
Ethical Sapiens therefore rejects the naive expectation:
if everyone knew the facts, everyone would behave ethically.
Institutions matter.
Economic transitions matter.
Accessible alternatives matter.
Stories matter.
Social norms matter.
Section 10
Ethical justification is not a complete theory of motivation#
This framework primarily addresses what can be justified, not the entire psychological problem of what motivates beings to act upon justified conclusions.
Showing that a position is rationally defensible does not guarantee that an individual or civilization will adopt it.
Identity, emotion, belonging, habit, incentives, narrative, imitation and institutions all affect behaviour.
A complete culture of Ethical Sapiens would therefore require more than argument.
It would also require education, examples, stories, practices, institutions and accessible alternatives capable of translating moral understanding into lived norms.
Narrative can do things abstract propositions cannot.
A story can lead a person to judge a case before realizing that the same judgment applies to themselves.
Thought experiments can partially remove identity cues that trigger defensive reasoning.
Art can make a distant subject psychologically visible.
This is one reason Ivan Karamazov belongs in this essay rather than merely in its bibliography.
Reason can establish a case. It cannot, by itself, guarantee that anyone will care.
Ethical Sapiens therefore distinguishes the problem of moral justification from the equally real problem of moral transmission.
Section 11
Moral values are plural#
Suffering is not the only morally relevant property of a life.
If morality were merely the elimination of negative experience, a lifeless universe would contain no suffering.
So would a civilization in which every conscious being were permanently sedated.
That omits too much.
Ethical Sapiens therefore recognizes:
- suffering
- positive experience
- flourishing
- bodily integrity
- agency
- relationships
- continued existence
- and meaningful preferences.
These values are related, but they are not interchangeable. A life may contain pleasure while lacking agency. Avoiding pain can sometimes require restricting freedom. Preserving life can conflict with bodily integrity, relationships or the interests of other sentient subjects.
Ethical Sapiens therefore does not assume that every moral conflict can be reduced to maximizing one underlying quantity. Different morally relevant interests can remain genuinely distinct, and their importance can vary with the capacities, circumstances and stakes of the beings involved.
This pluralism creates an immediate problem:
How should these values be weighed when they conflict?
Section 12
Why Ethical Sapiens rejects a universal moral ruler#
We possess no scientifically validated unit capable of translating every morally relevant interest into one universal quantity.
There is no defensible device telling us:
- this grief = 84 units
- this pain = 137
- this loss of autonomy = 61
then translating them reliably across humans, pigs, octopuses and artificial minds.
Pretending otherwise would be false precision.
Ethical Sapiens therefore rejects predetermined cardinal exchange rates.
But lack of exact measurement does not imply total ignorance.
Many comparisons are robust across extremely wide ranges of plausible weighting.
We need no exact suffering ratio to know that extreme torture is not ordinarily justified by a marginal improvement in flavour.
Section 13
The moral court#
Complex conflicts should be examined using the widest reasonably achievable scope of relevant interests and consequences.
Relevant considerations may include:
- sentience probability
- severity and duration of harm
- positive welfare
- agency
- bodily integrity
- relationships
- continued existence
- special obligations
- alternatives
- necessity
- uncertainty
- reversibility
- systemic effects
- action
- and inaction.
The purpose is not an infinitely long checklist.
It is to prevent one convenient variable from silently determining every case.
Begin with an affected-subject visibility check. Identify who bears each cost, whose interests disappear in an institution-centred description, and who is affected by inaction. Visibility neither establishes alleged harm nor makes the most emotionally salient subject decisive.
Then use a role-sensitive reversal test: would the permission retain its justification if another group or a more powerful agent invoked the same reasons? This tests symmetry of reasons, not identical outcomes or whether the evaluator would enjoy the treatment. Capacity, need, agency, dependency, circumstances, alternatives and special obligations remain relevant; reversal must not erase legitimate partiality or project human preferences onto other beings.
Where intervention and prevention both impose serious burdens, state both. The status quo is not neutral merely because it is familiar. Multiple burdens are not automatically equal, do not cancel each other, and do not erase the distinction between imposing harm and allocating rescue.
The aim is the widest reasonably achievable understanding of morally relevant consequences using the best evidence, reasoning and computational tools reasonably available at the time.
The court seeks the best-justified decision available under that understanding. It does not demand omniscience or guarantee the objectively best outcome. Sections 18 and 19 govern when inquiry should stop, so a demand for wider analysis cannot become a pretext for costly indefinite delay.
Section 14
Three possible outcomes#
Ethical Sapiens distinguishes three broad outcomes.
Determinate#
One option becomes decisively better justified.
Epistemically unresolved#
Relevant facts remain unknown and additional investigation could materially alter the result.
Genuinely morally indeterminate#
The relevant facts are sufficiently resolved, yet several acknowledged moral reasons remain without one clearly overriding the others.
But genuine indeterminacy cannot simply be declared.
The default classification of an unresolved practical case is epistemic unresolvedness, not genuine moral indeterminacy.
The burden of establishing genuine indeterminacy rests on whoever claims it.
That burden is met only where further reasonable factual investigation is unlikely to resolve the conflict because the disagreement concerns weighting of acknowledged moral reasons rather than missing, disputed or poorly investigated facts.
Genuine indeterminacy is a conclusion reached after the epistemic burden has been discharged, not an escape from investigation.
Section 15
The burden of justification rises with imposed harm#
The more severe, involuntary, irreversible or widespread a harm an agent proposes to impose, the stronger the burden of justification.
The proposer must increasingly establish:
- that the objective is morally serious
- that the harm is proportionate
- that adequate less harmful alternatives are unavailable
- that the evidence is sufficiently strong
- and that the expected benefit is not merely convenient speculation.
This creates a central asymmetry between:
May I seriously harm or instrumentalize you for my objective?
and:
Which one of two subjects can I rescue when both cannot be saved?
The former has an identifiable burden-bearing proposer.
This burden asymmetry is the principal verdict-producing mechanism of Ethical Sapiens.
Much of the remaining architecture exists not to manufacture more verdicts, but to make difficult verdicts more informed, legitimate, accountable and worthy of trust.
That limitation is intentional.
Section 16
Avoidable suffering and competing harms#
The phrase unnecessary suffering is too easily manipulated.
Almost any institution can label its preferred practice necessary.
Ethical Sapiens therefore defines avoidable suffering as:
Suffering for which a reasonably available alternative can achieve the morally relevant objective with substantially less expected harm and without producing competing harms sufficiently grave to defeat the alternative's moral advantage.
The second clause matters.
A supposedly humane alternative cannot become superior merely by transferring equal or worse suffering somewhere less visible.
But this is not a total-harm calculator.
Ethical Sapiens separately recognizes rights, instrumentalization, agency and special responsibilities.
Thus the relationship between Sections 15 and 16 is:
The burden against seriously harming or instrumentalizing a sentient subject remains the starting point. Competing harms can defeat a proposed alternative when they are sufficiently severe, foreseeable and difficult to reduce that the alternative no longer represents a meaningful moral improvement.
The mere existence of some collateral harm does not cancel the burden.
Nor does calling harm indirect make it morally irrelevant.
Where collateral harm is severe, foreseeable and reasonably avoidable, responsibility arises to reduce it.
Section 17
Capability creates a duty to expand alternatives#
Capability-indexed necessity is central to Ethical Sapiens.
A practice can be necessary under one technological regime and avoidable under another.
But this produces a loophole.
An actor benefiting from a harmful practice can avoid developing alternatives and continue calling the practice necessary.
Therefore:
Agents with substantial ability to develop, fund, support or make available less harmful alternatives acquire a positive responsibility proportional to that ability to expand the space of better alternatives.
Furthermore:
A necessity defence is weakened or void where the claimant's own obstruction, avoidable neglect, lobbying or investment strategy materially caused or maintained the absence of a less harmful alternative.
Strategic incapacity is not moral innocence.
Inherited permission is not a permanent necessity defence. Past acceptance establishes that a practice was accepted, not that it remains justified. Context-dependent permissions should be reassessed when relevant knowledge, circumstances or reasonably accessible alternatives materially change. Tradition, institutional approval and legality can contribute knowledge or morally relevant considerations, but none alone discharges the burden for serious imposed harm.
Reassessment can reaffirm the earlier conclusion. Newer is not automatically better, principles are not reduced to historical fashion, and changed facts do not dictate values without the normative bridge in Section 5. The duties to expand alternatives and not obstruct them remain in force.
Section 18
Epistemic humility does not require infinite hesitation#
How much evidence is enough?
Absolute certainty is usually unavailable.
There is always another model.
Another indirect effect.
Another what if?
If responsible action required elimination of every conceivable uncertainty, almost no significant action could occur.
But waiting also produces consequences.
Thus:
Epistemic humility does not require infinite hesitation.
The relevant question is not:
Do we know everything?
It is:
Is additional inquiry reasonably expected to improve the decision enough to justify the moral costs and risks of delay?
Section 19
A practical epistemic stopping rule#
The evidential burden should scale with:
- magnitude
- uncertainty
- systemic reach
- and irreversibility.
The costs of waiting must also be considered.
Thus:
Continue seeking additional information while its expected moral value plausibly exceeds the expected moral cost of delay.
But value-of-information estimates are themselves model-dependent.
A model cannot correctly value investigation into mechanisms it does not represent.
Therefore:
Calculated value of information should not be treated as complete or decisive where plausible structural uncertainty, unknown regime shifts or unmodelled causal mechanisms remain.
In such cases, structural uncertainty raises the stopping threshold and creates additional reason for adversarial, exploratory and out-of-model investigation.
A confident model is not necessarily a complete model.
Sections 55 to 58 return to this problem in the context of complex adaptive systems, where it becomes most consequential.
Section 20
Epistemic trust must be earned#
"To the best of our knowledge" cannot mean:
I personally feel confident.
Before high-stakes action, agents should actively try to discover why they may be wrong.
Did they seek disconfirming evidence?
Did serious critics have access to assumptions?
Were models independently tested?
Would the same evidence be interpreted differently if the result were financially, politically or emotionally inconvenient?
Were failure conditions defined beforehand?
Could the intervention be tested at a safer scale?
Comparable claims should face comparable standards. Different weight requires relevant differences such as source reliability, independence, method, corroboration, background evidence or causal fit — not allegiance. Symmetry does not make every testimony or study equal, and background assumptions must remain open to scrutiny rather than becoming permanent shields.
Responsible reasoning relies on testimony and expertise; nobody must personally repeat every investigation. Deference is earned through relevant competence, transparent methods, track record and accountability. A title is neither proof nor disproof. Expertise about what an institution teaches does not by itself establish that the teaching is true. Repetition by institutions, publications or AI tools sharing data, assumptions or dependence is not independent corroboration.
Extraordinary claims require extraordinary evidence. Defensibly understood, a claim that substantially conflicts with independently well-supported knowledge requires evidence strong, reliable and discriminating enough to overcome that conflict. Extraordinary must not mean merely unfamiliar, culturally unwelcome or inconvenient.
The evidence needed for confident acceptance of an explanation can exceed what is needed for proportionate, low-risk precaution. Credible uncertainty may warrant care before it warrants belief. The slogan must not become an impossible proof demand for reports of suffering, animal sentience or possible artificial sentience.
Trust yourself when action becomes necessary, but earn that trust first.
Section 21
Motivation matters, but intentions are not evidence#
A compassionate motivation is morally different from sadism or indifference.
But good intention cannot establish that an empirical prediction is true.
History contains many catastrophic benevolent mistakes.
Therefore:
A compassionate purpose strengthens the reason to pursue a beneficial outcome. It does not reduce the evidential burden required to believe that a particular intervention will achieve it.
Conflicts of interest matter too.
The greater the benefit an evaluator receives from approval of an intervention, the weaker the justification for allowing that evaluator's own confidence to determine evidential sufficiency.
This applies to ideological and emotional investment as well as money.
Psychological labels do not answer arguments. Alleged pride, fear, anger, immaturity, identity attachment or desire for comfort matter only where they identify a relevant evidential or inferential problem. Demonstrated unreliability and conflicts of interest can reduce the weight of testimony without proving its conclusion false. Tone can affect communication and justify boundaries without settling the substantive issue.
Ethical Sapiens advocates do not receive exemption from Ethical Sapiens' epistemic standards.
Declining an exhausting or disrespectful conversation is not evidence of a self-sealing worldview. Nor is saying “you lack compassion” a substitute for answering criticism of Ethical Sapiens.
Section 22
Epistemic negligence#
Ignorance is not always innocent.
Institutions can underfund threatening research.
Researchers can design unfalsifiable studies.
Governments can exclude critics.
Individuals can avoid inconvenient evidence.
Therefore:
Agents have a duty to reduce morally relevant ignorance when the stakes and their capacity to investigate make that effort reasonable.
Failure to seek reasonably accessible disconfirming evidence can constitute epistemic negligence.
An agent cannot create a weak evidential environment and later defend disaster by saying:
We used the best evidence available.
The relevant question is:
Was the available evidence weak partly because you failed in your responsibility to know better?
Section 23
Continued existence is an interest#
Why is painless killing a harm?
Suppose an animal living a good life is instantly killed while asleep.
No painful dying occurs.
But an ongoing sentient life contains future goods dependent upon continued existence.
A sentient being can seek safety, food, companionship, comfort, play and exploration even if it cannot formulate:
I want to remain alive ten years from now.
Thus:
Continued existence need not be represented as an abstract future-directed preference in order to constitute an interest.
Section 24
The continuation interest is graded#
The badness of death need not be identical for every sentient being.
The richness, temporal continuity and structure of future goods can vary.
Long-term projects, anticipation, autobiographical memory and complex relationships may add categories of loss.
Another animal may possess a simpler but still genuine experiential future.
The continuation interest can vary in strength without disappearing merely because a subject lacks human-like cognition.
Section 25
The happy-animal paradox#
A familiar defence says:
The animal had a good life.
But if its life was good, continuing that life contained further potential goods.
Premature killing removes them.
Thus:
The better an animal's life is claimed to be, the stronger the acknowledgement that continuing the life contains something valuable for that animal.
Creating another happy animal does not restore the future lost by the first.
Sentient subjects are not morally replaceable merely because similar subjects can later be created.
Section 26
Killing and every possible form of use are not identical#
The continuation argument can strongly condemn premature killing.
It does not by itself establish that every possible relationship from which humans benefit is wrong.
Imagine an animal living healthily into old age without substantial coercion, deprivation or loss of agency.
Other questions become relevant.
Was dependency artificially created?
Was reproduction manipulated?
Were preferences respected?
Was bodily integrity violated?
Was vulnerability exploited?
Ethical Sapiens therefore evaluates actual interests and relations rather than assuming:
all use = identical wrong.
Section 27
Anti-instrumentalization#
A central protection follows:
A sentient subject with a life of its own should not ordinarily be treated merely as a resource for another's trivial or readily replaceable interests.
Instrumentalization matters because the subject's own good is subordinated to a project in which the subject becomes the means, material or production resource.
This is not merely a claim about the agent's internal intention.
It is a claim about the relationship imposed upon the subject.
The being's body, labour, reproduction, captivity or death becomes part of another agent's project despite the being's competing fundamental interests.
This relation carries an especially strong burden of justification.
Section 28
What rights mean#
Rights are not absolute lexical barriers defeating every conceivable consequence.
Nor are they ordinary preferences.
Within Ethical Sapiens:
A right is an especially strong burden-allocating protection attached to morally important interests, designed so that convenience, ordinary aggregation and power cannot casually override them.
Rights change the default.
The burden rests upon whoever seeks the override.
Section 29
Species does not determine the threshold#
Relevant factors include:
- sentience
- severity and duration
- positive and negative experience
- future goods
- agency
- relationships
- numbers affected
- uncertainty
- alternatives
- and systemic consequences.
Species is not itself a fundamental multiplier.
Cognitive sophistication matters only through morally relevant interests it enables.
Cognition matters through interests, not because intelligence itself grants superior moral rank.
Section 30
Catastrophic overrides#
Imagine one sentient subject must undergo severe harm to prevent a catastrophe killing one billion others.
Suppose confidence is extraordinary and no adequate alternative exists.
Ethical Sapiens permits the override.
The victim's standing does not vanish.
The case remains tragic precisely because the victim matters.
Substitute an innocent human.
Species membership alone does not create an infinitely strong protection defeating literally every imaginable consequence.
At sufficiently catastrophic stakes, even extremely strong rights may in principle be overridden.
Section 31
The marginal-cases implication#
Species neutrality has a difficult implication.
Imagine a perfectly isolated forced choice between a human possessing drastically fewer relevant interests and a nonhuman animal possessing richer agency, relationships, future goods and welfare capacities.
If literally every morally relevant consideration favours the nonhuman animal, Ethical Sapiens cannot secretly reintroduce species membership at the final step.
It must follow its own criteria.
That implication may be socially disturbing.
But denying it would abandon non-arbitrariness exactly where it becomes uncomfortable.
Section 32
Individual moral ontology and institutional protection#
Real legal systems are not perfect philosophical thought experiments.
Humans with cognitive disabilities live within relationships, communities and institutions.
Our knowledge of inner lives remains imperfect.
A legal system empowering officials to decide which humans possess less protection would create enormous risks of discrimination, abuse, fear and epistemic error.
Therefore strong and effectively universal legal protection for humans can be justified even within a species-neutral ontology.
But intellectual honesty requires one further admission:
Part of this rule-level justification depends upon contingent facts about institutions, epistemic limits and the consequences of granting ranking authority. It is therefore, like other derived institutional conclusions, corrigible in principle.
If those background facts changed radically, the institutional argument would have to be reassessed.
This does not weaken present protection.
It makes explicit why the protection is justified rather than treating a present institutional rule as metaphysically untouchable.
Section 33
Partiality is morally real#
Love matters.
Dependency matters.
Promises matter.
History matters.
A parent possesses obligations toward their child that are not identical to their obligations toward every child.
A guardian possesses special responsibilities toward an animal who depends upon them.
Thus:
Agent-relative relationships generate genuine moral reasons.
Section 34
Partiality has no fixed exchange rate#
Ethical Sapiens rejects false precision such as:
one family member = forty-seven strangers.
No defensible universal exchange rate exists.
Thus:
The limit of legitimate partiality is determined within the circumstances of the case rather than fixed numerically in advance.
Partiality is not infinite.
At sufficiently extreme disparities, impartial reasons may become decisive.
Section 35
Indeterminacy does not mean fifty-fifty#
Suppose someone can rescue either a deeply loved dependent dog or an unknown human.
Both possess profound interests in continued life.
The agent also possesses a special responsibility toward the dog.
In a sufficiently constrained case, more than one choice might remain morally permissible.
That does not mean equal justification.
One option may be much stronger from an impartial perspective.
The other may rest upon powerful relational reasons.
Permissibility is not numerical equality.
Section 36
Moral character should not casually determine standing#
Unknown people should not receive a moral discount because we suspect that statistically they might be selfish, cruel or morally inconsistent.
Concrete behaviour can matter where it changes consequences.
An actual intention to murder others after rescue would obviously matter.
But Ethical Sapiens should not create a general ranking:
virtuous human > flawed human > animal.
Standing tracks interests.
Character matters where it materially alters relevant consequences.
Section 37
Partiality does not lower the burden for harming outsiders#
There is a difference between:
I devote more of my own time to someone I love
and:
I severely harm outsiders because someone I love benefits.
Thus:
Special relationships can create reasons to benefit insiders without automatically lowering the burden required to impose severe harm on outsiders.
This prevents loyalty from becoming a licence for tribal exploitation.
Section 38
Negative and positive responsibilities#
Responsibilities not to impose severe avoidable harm are generally stronger than responsibilities to eliminate every harm one could conceivably address.
Otherwise morality could consume every capable person's entire life.
Positive duties therefore permit latitude.
But not unlimited latitude.
Ethical Sapiens adopts a fair-share structure.
The negative duty not to deliberately obstruct less harmful alternatives is strong. The affirmative duty to fund, develop or enable alternatives is positive, proportional and latitude-bearing.
Fair share depends upon:
- capacity
- causal contribution
- benefits obtained from the harmful system
- institutional role
- comparative ability to produce change
- tractability
and what would reasonably be required of similarly situated actors under full compliance, not merely whatever low level of effort others currently happen to provide.
This matters because collective underperformance cannot reduce every participant's duty toward zero.
A multinational corporation, state, university and ordinary consumer therefore possess different responsibilities.
Section 39
Veganism as a derived conclusion and adversarial test#
Animal ethics is not an independent axiom of Ethical Sapiens.
It follows from broader commitments.
Many animals are sentient or strong sentience candidates.
Their suffering matters.
Their agency can matter.
Their continued lives can matter.
Their species membership does not erase these interests.
The ordinary dietary case then presents a specific structure.
Where adequate alternatives exist, animal-derived food commonly serves interests such as:
- taste
- habit
- convenience
- tradition
or cultural preference.
These can be genuine human interests.
But they are generally not comparable in gravity to another sentient subject's interests in avoiding confinement, bodily violation, severe suffering and premature death.
The central Ethical Sapiens argument is therefore:
Where adequately nourishing and reasonably accessible alternatives exist, creating, controlling or using sentient animals as production resources for replaceable dietary preferences carries a burden of justification that ordinary preference does not satisfy.
The key relation is instrumentalization, not merely whether harm was intended or foreseen.
A farmed animal is incorporated into a production system in which its body, reproductive capacities, secretions, labour or death are used as resources for another agent's objective.
In many actual animal-production systems the animal is also deliberately bred into a relationship of human-created dependency and control, which creates further responsibility.
A wild mouse harmed during crop harvesting is also a morally relevant victim.
Its suffering does not matter less from its own point of view.
But the mouse has not thereby become the production resource whose body or reproductive system constitutes the commodity.
That difference does not make field deaths morally irrelevant.
It identifies a different moral relation.
The field-deaths challenge#
A serious framework must nevertheless confront the strongest objection.
Steven Davis argued that some agricultural systems involving large grazing animals might be associated with fewer animal deaths than some crop systems.
Gaverick Matheny challenged important parts of Davis's analysis, including its population comparison, and argued that correcting the calculation favoured vegetarianism.
Fischer and Lamey later emphasized something especially important for Ethical Sapiens: existing evidence about deaths caused by plant agriculture remains deeply incomplete, and depending on how uncertain empirical and philosophical questions are resolved, it remains possible that some diets containing animal products could be associated with fewer total animal deaths than some plant-based alternatives.
That possibility should not be softened merely because it is inconvenient.
Ethical Sapiens should state it directly.
And then ask what follows.
It does not follow that instrumentalization becomes morally irrelevant.
A total death count is not the sole moral variable in this framework.
Rights, agency, continued life, created dependency and instrumentalization remain independently relevant.
At the same time, the framework cannot simply ignore collateral deaths because they do not fit the preferred conclusion.
If a particular plant-production system predictably imposed sufficiently severe sentient harm, and another feasible system avoided both that harm and animal exploitation, there would be an obligation to prefer the better system.
If some highly unusual dietary case genuinely produced sufficiently grave competing harms to defeat an otherwise less exploitative alternative, the court would have to recognize it.
The label vegan possesses no intrinsic moral privilege.
Veganism within Ethical Sapiens is therefore a robust general conclusion for ordinary circumstances in which adequately nourishing alternatives exist, not an exceptionless purity command and not a claim that every plant-production system necessarily causes less total sentient harm than every conceivable animal-production system.
Environmental evidence#
Animal agriculture also generally imposes very large land, resource and environmental burdens.
Research such as Poore and Nemecek's global analysis is highly relevant to environmental policy.
But Ethical Sapiens must be precise about what this evidence establishes.
Because the framework does not assume that the net welfare of all wild animal populations is positive, greater land occupation or habitat transformation cannot automatically be translated into a known quantity or even universally known direction of net sentient welfare.
Environmental burden is therefore an independent and often very important consideration, but it should not be smuggled into the sentient-welfare ledger under an unstated assumption about wild welfare.
This is exactly the sort of bridge premise Ethical Sapiens' own epistemic standards require us to expose.
Nutritional scope#
The Academy of Nutrition and Dietetics' 2025 position concludes that appropriately planned vegetarian and vegan dietary patterns can be nutritionally adequate for adults and can provide long-term health benefits.
That position is specifically scoped to nonpregnant, nonlactating adults.
Ethical Sapiens should not silently generalize it to groups the paper excludes.
Children, pregnancy, lactation and specialized medical circumstances require their own evidence and fall under the context-sensitive necessity standard.
The framework's conclusion is therefore not:
Everyone must eat identically regardless of circumstance.
It is:
Where an adequately nourishing, reasonably accessible alternative exists, ordinary taste, habit or cultural preference does not provide sufficient justification for using sentient subjects as production resources in ways that override their fundamental interests.
Genuine necessity can change the verdict.
Section 40
The existence defence fails#
A familiar defence says:
The animal would never have existed without farming.
Before the animal exists, no individual has been deprived because we failed to create it.
After creation, a subject exists whose welfare, agency and continued life matter.
Thus:
Creating a sentient being does not purchase permission to exploit it.
Creation generates responsibility.
Section 41
Guardianship rather than fictional consent#
Animals, young children and some cognitively impaired humans cannot enter ordinary informed contractual relationships.
Describing a relationship as mutually beneficial is therefore insufficient.
A better model is guardianship.
Where a dependent sentient subject cannot meaningfully consent, the more powerful agent assumes fiduciary-like responsibilities to act primarily in the dependent's interests, infer preferences carefully, preserve agency where possible and avoid exploiting dependency for the guardian's benefit.
Dependency creates responsibility rather than morally unrestricted ownership.
Section 42
Survival and genuine necessity#
Suppose someone is starving and can survive only by killing an animal.
Ethical Sapiens permits it.
The animal's interest in living does not disappear.
The competing survival interest becomes sufficiently grave to override it.
The same act performed for replaceable taste preference in circumstances of abundant alternatives is not morally equivalent.
Identical physical acts can possess radically different moral status under different necessity and capability conditions.
Section 43
Science, evidence and values#
Values influence which questions are researched, which risks are acceptable, which experiments are permissible and what evidence threshold is needed before action.
Therefore:
Values may legitimately influence research priorities, ethical constraints, acceptable risk and evidential thresholds for action, but they should not substitute directly for empirical evidence concerning what is factually true.
An experience, a report or recollection of it, the explanation attributed to it, and the broader conclusions drawn from it are different claims. Reports of pain, fear, relief, love or meaning can be genuine but fallible evidence. Disputing a proposed cause does not erase the experience; intensity, sincerity or practical benefit does not by itself establish a particular causal or metaphysical interpretation.
Subjective experience is not evidence only about an inner world. Ordinary perception and testimony can support beliefs about external events. Where explanations compete, ask what would discriminate among them, with inquiry proportional to the stakes. Reasonable care need not wait for independent proof of a person's pain. Equally, an engineered self-report does not conclusively establish artificial sentience; Sections 73 and 74 still apply.
Precaution is principally a decision rule under uncertainty.
Open data, replication, methodological pluralism and adversarial criticism help prevent values from becoming evidence.
Section 44
Technological power expands moral responsibility#
Hans Jonas argued that modern technological power creates new responsibilities because actions can affect distant generations and planetary conditions on unprecedented scales.
Ethical Sapiens shares the basic power-to-responsibility intuition while extending moral concern beyond humanity and remaining less categorically precautionary than Jonas.
Technology changes what can be done.
What can be done changes what can honestly be called necessary.
The boundary between unavoidable tragedy and preventable harm moves with capability.
This is more than a claim about efficiency.
Biological history contains many different strategies for obtaining the energy and materials that life requires, but almost no organism can survey that space or deliberately construct a new option within it.
Human intelligence introduces exactly that capacity.
No moral conclusion follows from the mere existence of less harmful biological strategies, and nothing is settled by observing that some organisms sustain themselves without harming sentient beings.
The relevant point concerns capability rather than natural precedent.
The moral importance of technology lies partly in expanding the objectives we can achieve without harms that earlier organisms had no practical way to avoid.
This is one reason capability creates responsibility.
Section 45
Power creates responsibility to develop alternatives#
Governments, corporations, universities and wealthy societies cannot always morally wait for someone else to invent a better system.
Where existing systems impose severe harm, sufficiently capable agents may acquire duties to research and enable alternatives.
These positive duties remain fair-share bounded.
A corporation profiting directly from a harmful practice can carry more responsibility than an individual consumer.
A government controlling infrastructure can carry more than either.
Capability eventually creates responsibility not merely to choose between available options but to expand the option set itself.
Section 46
Naturalness is not moral authority#
Evolution has produced extraordinary beauty.
It has also produced:
- predation
- parasitism
- disease
- starvation
- injury
- infanticide
- and terror.
Natural selection is not known to optimize subjective wellbeing.
Therefore:
Natural origin is not sufficient moral justification for preserving a process.
Moreover, appealing selectively to nature creates another problem.
Predation is natural.
But empathy is natural too.
Disease is natural.
Medicine is natural in exactly the same descriptive sense: it is behaviour produced by organisms that evolved within nature.
Thus:
Calling a process natural tells us how it arose, not whether it ought to be preserved. Selecting predation or disease as morally authoritative while dismissing compassion, medicine or deliberate harm reduction as unnatural interference is an arbitrary choice among natural capacities.
This does not establish that intervention is wise.
It establishes only that nature did it is not the end of moral reasoning.
Section 47
Wild-animal welfare is an empirical question#
Wild animals clearly undergo severe harms.
But Ethical Sapiens does not assume that wild lives are generally net negative.
Yew-Kwang Ng's early welfare-biology work explored reasons why suffering might dominate in nature.
Groff and Ng later identified an error in the original model; correcting it removed the earlier suffering-dominance conclusion and left the overall balance ambiguous.
That correction is methodologically important.
The appropriate response when an attractive theory fails is not to protect the theory, but to become less certain.
Browning and Veit likewise challenge sweeping assumptions that wild welfare is necessarily net negative.
Ethical Sapiens therefore adopts neither romantic optimism nor global suffering pessimism.
It adopts investigation.
Section 48
Sentiocentrism: the explicit environmental choice#
Ethical Sapiens is fundamentally sentiocentric.
An ecosystem, species or evolutionary lineage is not currently known to possess a unified subjective point of view.
Individual sentient organisms do.
Therefore ecosystems and non-sentient species do not receive direct welfare standing merely because they exist.
They can nevertheless possess enormous:
- instrumental
- relational
- scientific
- aesthetic
- resilience
- epistemic
- and option value.
Section 49
The hard environmental thought experiment#
Imagine:
World A contains vastly greater non-sentient biodiversity and extensive unmanaged evolution.
World B contains lower biodiversity and greater management, but every sentient subject has substantially better welfare and flourishing.
Assume, unrealistically, that every systemic effect is understood and that no future sentience is lost through eliminated lineages.
Ethical Sapiens chooses B.
This establishes a value ordering under stipulated knowledge.
It does not establish that humanity is justified in constructing B.
The epistemic conditions of the thought experiment may never exist in reality, for reasons developed in Section 56.
Value priority is not an intervention licence.
Section 50
Why biodiversity nevertheless matters enormously#
Real biodiversity contributes to ecological resilience, scientific information, evolutionary possibility, cultural value, option value and the functioning of systems upon which sentient life depends.
Our knowledge is incomplete.
Therefore strong biodiversity protection can follow from sentiocentrism without pretending ecosystems themselves experience welfare.
There is another reason too.
Section 51
Corrigibility requires preserved novelty#
If every ecosystem were engineered according to our current models, future observations would increasingly come from systems those same models created.
Unmanaged systems generate:
- novel adaptations
- unexpected interactions
- anomalies
- and evolutionary experiments we did not predict.
Those surprises can expose failures in our understanding.
Thus:
Preserving substantial unmanaged domains can possess epistemic and therefore moral value because open-ended natural processes help reveal what our models fail to understand.
Wildness need not possess sacred intrinsic status for unmanaged nature to be epistemically precious.
Section 52
Agency is a direct cost of control#
Control matters even if ecological prediction were perfect.
Agency is itself one of the interests Ethical Sapiens recognizes.
Managing reproduction, movement, social organization or behaviour can therefore impose a direct cost.
Control is morally costly not only because the controller may make mistakes, but because control can itself override agency.
That cost may sometimes be justified.
But it belongs inside the court.
Section 53
From dominion to stewardship#
If humanity eventually develops reliable means of reducing severe naturally occurring suffering without creating comparable or greater harms, capability may create responsibility beyond harms humans originally caused.
Increasingly capable civilization may acquire responsibilities of stewardship toward sentient welfare within the biosphere.
Dominion asks:
What can we control?
Stewardship asks:
What are we sufficiently justified in changing, for whose benefit, with what evidence, at what risk and under what constraints upon our own power?
Section 54
Research-first stewardship#
At present many ambitious wildlife interventions would be epistemically irresponsible.
Responsibility therefore often points first toward research:
- better welfare indicators
- better ecological modelling
- longitudinal observation
- disease prevention
- small reversible pilots
- monitoring
- replication
- and adversarial analysis.
This is not indefinite delay.
It is an attempt to expand the set of actions that could one day become responsibly available.
Section 55
Staged intervention#
Complex-system interventions should ordinarily move through increasing scale where possible.
Local and reversible before regional.
Regional before systemic.
Failure conditions should be declared beforehand.
But successful pilots do not guarantee successful scaling.
A nonlinear system may behave predictably until a threshold is crossed.
Thus:
Scaling is itself an empirical hypothesis.
Confidence should not increase mechanically merely because smaller pilots worked.
Section 56
Some limits of prediction may be structural#
Complex adaptive systems can exhibit:
- path dependence
- emergence
- thresholds
- hysteresis
- and regime shifts.
Some uncertainty may remain structurally irreducible.
If so, some forms of planetary management may never satisfy the evidential burden.
This is a valid verdict:
We may know what outcome we would value under perfect knowledge while remaining permanently unjustified in attempting to engineer it.
But there is also a middle band.
Structural uncertainty about planetary redesign does not automatically prohibit every limited wildlife intervention.
Vaccination programmes, disease control, local fertility management, predator removal on constrained islands or other bounded interventions can each be judged according to their actual scale, reversibility, evidence and alternatives.
Thus Ethical Sapiens allows neither:
planetary uncertainty means never intervene anywhere
nor:
local success licenses planetary design.
Scale changes the court.
Section 57
Procedural responsibility and objective harm are different#
Suppose a civilization acts after unusually serious research, independent criticism and reasonable attention to uncertainty.
Later science reveals an unforeseen mechanism and the intervention proves harmful.
Two things can simultaneously be true:
the original decision may have been epistemically blameless;
the resulting state may nevertheless be morally bad.
Blameless error remains error.
Where possible, harm creates duties to:
- stop continuing damage
- repair
- compensate where meaningful
- disclose failure
- preserve evidence
- and reform institutions.
But:
A duty to repair must never be mistaken for evidence that repair will be possible.
"We will fix it later" is itself an empirical prediction requiring justification.
Section 58
Irreversible action and corrigibility#
A framework cannot praise correction while casually destroying the possibility of correction.
Thus:
Where a materially safer, staged or reversible route toward the same morally important objective remains reasonably available, a potentially catastrophic irreversible intervention should not be chosen instead.
The less meaningful repair would be after failure, the stronger the ex ante requirement to preserve reversibility.
An undischargeable duty of repair is not reassurance.
It is evidence that greater caution was required beforehand.
Section 59
Artificial prey and future ecological engineering#
Imagine future technology capable of producing non-sentient artificial prey suitable for predators.
Predatory behaviour might continue while sentient prey no longer undergo terror and dismemberment.
The example does not predict that such technology will exist.
Nor does it solve population dynamics, nutrient cycling or disease.
It illustrates a narrower point:
Technology can transform harms previously treated as necessary into harms for which alternatives become conceivable.
Section 60
Ethical biological design#
Humanity has modified organisms for thousands of years.
Future biotechnology may make deliberate biological design enormously more powerful.
Ethical Sapiens does not infer:
we can redesign life, therefore we should.
Instead:
Biological modification becomes increasingly justified only where strong evidence indicates substantial sentient benefit, relevant agency is respected as far as possible, adequate less harmful alternatives are unavailable, and systemic risks satisfy the appropriate burden.
The greater the power, the stronger the burden.
Section 61
Governance cannot be reduced to expert confidence#
Scientific expertise does not create unlimited political authority.
Large interventions require contestable governance.
Relevant disciplines require representation.
Independent critics require access to evidence.
Affected human communities require representation.
Nonhuman interests require fiduciary proxies.
High-impact interventions require monitoring, appeal, reconsideration and termination mechanisms.
Planetary consequences demand correspondingly broad legitimacy.
The purpose of governance is not to eliminate error.
It is partly to make hidden error, self-interest and capture more difficult to sustain.
Section 62
The legitimacy gap for non-participating beings#
A fox cannot elect a representative.
A whale cannot veto a marine intervention.
An infant cannot authorize guardianship like an autonomous adult.
Therefore decisions affecting non-participating subjects cannot achieve full consent-based political legitimacy.
Ethical Sapiens should not pretend otherwise.
It substitutes a weaker standard:
fiduciary representation, transparency, contestability, heightened burden upon the proposer, reversibility where possible, and additional restraint precisely because affected beings cannot authorize the decision themselves.
The gap cannot be eliminated.
Recognizing it is preferable to pretending that humans speak with the consent of animals.
Section 63
Coercion is itself morally costly#
Pursuit of welfare does not grant unlimited power.
Surveillance, imprisonment, censorship, forced treatment and restrictions of liberty themselves affect welfare and agency.
Thus:
Coercion requires a sufficiently grave objective, evidence of effectiveness, lack of adequate less coercive alternatives and proportionality between enforcement and the harm prevented.
"For the greater good" is not moral permission.
It creates a burden.
Section 64
Precaution works in both directions#
Precaution is often invoked only against action.
But refusal to act can preserve enormous suffering.
If a disease is killing hundreds of thousands of sentient subjects, intervention carries risks.
So does continued disease.
Therefore:
Precaution evaluates both action and inaction.
This prevents status quo bias from masquerading as humility.
Section 65
Existential and civilizational risk#
Some losses are special because they destroy the ability to learn, correct and protect in the future.
Human extinction currently appears to be such a loss.
Not because Homo sapiens possesses sacred species status.
But because humanity is the only civilization presently known to possess large-scale scientific, technological and moral agency.
Therefore:
Speculative welfare gains should not justify non-negligible risks of irreversible civilizational catastrophe while materially safer routes toward the same objective remain available.
Section 66
Population ethics: nobody waits to be created#
Possible beings do not exist outside reality waiting for admission.
If two people decide not to have a child, no currently existing individual has been deprived.
Thus:
There is no general moral duty to create every possible happy sentient life.
Happy lives can be valuable without creating a duty to maximize their number.
Section 67
Existing lives and possible lives differ#
Once a sentient being exists, it possesses interests.
Future goods can be goods for that existing subject.
This is why killing an existing animal can deprive somebody, while failing to create another possible animal does not deprive an already existing individual.
The distinction is:
existing subject with a possible future
versus
merely possible subject with no current claim to existence.
Section 68
Flourishing life can be valuable without population maximization#
Future civilization could contain:
- love
- relationships
- discovery
- joy
- art
- curiosity
- and moral progress.
Its continuation can therefore be valuable.
But value does not automatically entail maximization.
Ethical Sapiens adopts a:
good-but-not-required
structure toward creating new flourishing life.
It therefore does not silently adopt total utilitarianism.
Section 69
Human extinction must be judged systemically#
Suppose humanity voluntarily ceases reproduction and disappears without violent death.
No nonexistent future person is directly harmed by never being born.
But broader consequences remain.
What happens to dependent animals?
Infrastructure?
Civilizational knowledge?
Future flourishing?
Stewardship capacity?
Wild suffering?
Risks created by humanity itself?
The court still applies.
Extinction can therefore be disfavoured without inventing a right of hypothetical individuals to be created.
Section 70
Different future populations and the Non-Identity Problem#
Present choices can change which future individuals exist.
Therefore Ethical Sapiens permits comparison between different possible future populations.
Same-number comparisons#
Where populations are comparable in size, we can compare:
- quality
- distribution
- structure
- and expected conditions of sentient lives.
Different-number comparisons#
Where population size differs substantially, Ethical Sapiens does not simply sum total welfare and automatically declare the larger positive population superior.
That would silently import total utilitarianism and undermine the claim that merely possible individuals possess no general claim to creation.
Thus:
The mere addition of additional positive lives does not automatically outweigh quality, rights, distribution or conditions in a smaller population.
Ethical Sapiens does not claim to possess a complete aggregation rule for different-number population ethics.
That remains an open problem.
Open problems should remain open rather than being accidentally answered by an unstated assumption.
Section 71
Creating life creates responsibility#
We need not create every possible happy being.
But once agents deliberately create a sentient being, responsibilities arise toward the conditions imposed upon it.
Creation is not moral credit cancelling later harm.
This applies to human reproduction, animal breeding and possible future artificial sentience.
Section 72
Radical longevity#
Future biotechnology may dramatically extend healthy lifespan.
Whether indefinite longevity is possible is unknown.
Ethical Sapiens does not depend upon assuming that it is.
But there is no principle declaring current evolved lifespan morally sacred.
If a subject wishes to continue living and healthy extension is safely possible, longer life can constitute a major benefit.
Conflicts involving resources, population and reproduction would return to the court.
Section 73
Artificial sentience#
Moral standing cannot logically depend upon carbon.
If artificial systems eventually possess genuine valenced subjective experience, substrate alone cannot erase their interests.
But AI presents unusual epistemic problems.
Surface reports of suffering can be produced through training without corresponding experience.
Behaviour can be engineered.
Ethical Sapiens therefore supports proportionate, gaming-resistant precaution rather than automatic personhood or automatic dismissal.
Section 74
Low-probability sentience at enormous scale#
Artificial systems create a new aggregation problem.
Suppose the chance that one system is sentient appears tiny while trillions of instances exist.
Naive expected-value reasoning can allow arbitrary speculative probabilities to dominate everything.
Ethical Sapiens rejects unlimited Pascalian aggregation.
Scale matters.
But so does the epistemic quality of the probability estimate.
Multiplying poorly grounded speculation by an enormous number does not transform pseudo-precision into knowledge.
Where reliable probabilities cannot yet be assigned, cheap reversible precautions and further investigation may be justified.
Section 75
Corrigibility must be operational#
A framework praising evidence should specify what could change its conclusions.
If strong evidence showed a taxon lacked sentience, its direct sentience-based standing would change.
If evidence showed a particular agricultural alternative produced much greater sentient harm, recommendations should change.
If ecological intervention repeatedly worsened welfare, confidence in interventionism should decline.
If reliable institutions fundamentally altered the empirical premises supporting a legal rule, that institutional conclusion would require reassessment.
If morally relevant non-sentient agency were established, the framework could expand.
But corrigibility requires more than imagining defeaters.
Where an important defeater is reasonably investigable, merely naming it is not enough.
An empirical explanation becomes insulated when apparent support raises confidence but relevant counterevidence is systematically neutralized by unsupported auxiliary claims, leaving no meaningful observation able to count against it. Compatibility with a belief is not the same as evidence favouring it over alternatives.
Allowing several outcomes is not itself defective; treating every outcome as confirmation is. Revising an explanation is legitimate when the revision is independently justified and exposes the new account to scrutiny again. Failing to name a defeater immediately differs from refusing in principle to recognize any counterevidence.
Insulation does not prove falsehood, reveal motive or show that a belief never rested on evidence. It damages the correction process and the confidence that process can warrant. Empirical explanations, historical claims, logical relations and normative commitments require appropriate and sometimes different scrutiny. Section 5's commitments are not laboratory hypotheses; they remain open to tests of coherence, arbitrary exclusion, counterexample, rival principle and implication.
A framework demonstrates corrigibility by exposing its preferred conclusions to serious attempts at refutation.
Section 76
Normative uncertainty#
Ethical Sapiens itself may be incomplete.
Consequentialism may capture important truths.
Rights theory may capture others.
Care ethics, contractualism, virtue ethics and capabilities approaches may reveal additional dimensions.
The framework's pluralism partly functions as a hedge under normative uncertainty.
Some practical conclusions survive disagreement remarkably well.
For example:
Do not impose severe avoidable harm on a sentient subject merely for trivial convenience where an adequate less harmful alternative exists.
Different moral traditions can reach that conclusion for different reasons.
Where traditions diverge sharply, Ethical Sapiens should increase normative humility rather than pretend the dispute has been solved.

Ethical Sapiens is not philosophy created from nothing.
Its components have important predecessors.
Bentham foregrounded suffering in animal ethics.
Ross developed plural prima facie duties and contextual judgment.
Regan developed strong rights-based animal protections.
Korsgaard argues that animals possess their own good and should not be merely instrumentalized.
Nussbaum emphasizes flourishing and capabilities.
Donaldson and Kymlicka develop relational and political approaches to animal dependency and agency.
Jonas connects technological power and responsibility.
Ng helped establish welfare biology.
Faria develops arguments concerning wild-animal suffering and future intervention.
Birch develops precaution under sentience uncertainty.
Contemporary sentientism likewise joins evidence, reason and concern for sentient beings.
Ethical Sapiens is therefore best described as:
a distinctive synthesis and procedural framework rather than an entirely new fundamental moral theory.
Its characteristic combination is:
- sentient standing
- non-arbitrariness
- plural interests
- strong burden-based protections
- anti-instrumentalization
- capability-indexed necessity
- responsibility to expand alternatives
- legitimate partiality
- earned epistemic trust
- operational corrigibility
- conditional stewardship
The individual pieces are not all new.
The architecture is the contribution.

What Ethical Sapiens is not#
It is not simple utilitarianism.
It is not absolute deontology.
It is not pure care ethics.
It is not ecocentrism.
It is not human supremacism.
It is not anti-humanism.
It is not negative utilitarianism.
It is not moral perfectionism.
It is not technological utopianism.
It is not passive naturalism.
It is not moral relativism.
It is not purity ethics.
It is not a universal death-counting algorithm.
And it is not a promise that every tragic dilemma has one computable answer.

The burden rises with imposed harm.
Epistemics#
Evidence must face comparable standards, independence checks and adversarial testing; uncertainty must be made explicit.
Capability#
What counts as necessary changes as alternatives become possible.
Responsibility#
Power can create responsibility to develop alternatives, not merely use them.
Agent-relative reasons#
Love, dependency and special responsibility legitimately matter but do not possess infinite weight.
Institutions#
Governance, fair-share duties, legitimacy, transparency and proportional coercion constrain power.
Future-facing ethics#
Population ethics, artificial sentience, existential risk and conditional stewardship extend responsibility beyond the immediate present.
The framework's main verdict-producing mechanism remains the burden against severe imposed harm and instrumentalization.
Much of the rest exists to determine whether that burden has actually been met.
Applied Case 8 shows the court working through fetal sentience, bodily autonomy, responsibility, alternatives, urgency and coercion without assigning any one consideration automatic victory.
A framework that honestly structures an unresolved conflict is better than one that fabricates a verdict merely to appear complete.
Section 80
The framework in condensed form#
Physical reality produced life.
Some life became sentient.
Sentient subjects acquired states that can go better or worse for them.
Given our commitment to taking such interests seriously, those subjects enter direct moral consideration.
Some sentient beings developed increasing knowledge and power.
Knowledge made more consequences foreseeable.
Technology created new alternatives.
Alternatives changed what could honestly be called necessary.
Capability therefore expanded responsibility.
Responsibility includes not merely using better alternatives but sometimes creating them.
Power also expanded the scale of possible error.
Therefore the burden of justification and evidence rises with severity, uncertainty, scale and irreversibility.
Evidence never becomes perfect.
Thus responsible agents must learn when to continue investigating, when supposed indeterminacy is merely ignorance, when delay itself causes harm, when structural uncertainty still blocks action, and when action has finally earned sufficient epistemic trust.
In condensed form:
Take sentient interests seriously without arbitrary exclusion. Make affected subjects and the burdens of action and inaction visible. Protect fundamental interests against instrumentalization for trivial or readily replaceable benefits. Seek the widest reasonably achievable understanding without demanding omniscience. Apply comparable evidential standards and distinguish independent corroboration from repetition. Treat competing harms seriously without reducing morality to a single total-harm ledger. Allow legitimate partiality without giving it infinite force. Test necessity against real alternatives and help create better alternatives as capability grows. Demand stronger evidence as intervention becomes more severe, systemic or irreversible. Treat genuine moral indeterminacy as something that must be established rather than declared. Preserve reversibility and the ability to discover error. Act when further uncertainty cannot reasonably be reduced and delay carries greater moral cost. Repair harm where possible, but never use the promise of repair to justify risks whose consequences may be irreparable. Remain willing to revise both empirical beliefs and derived moral conclusions.
Section 81
How Ethical Sapiens can be misused#
Any framework with substantive moral content can be selectively quoted.
Ethical Sapiens is particularly vulnerable because it permits exceptional overrides, intervention and coercion under sufficiently demanding conditions.
Several forms of misuse should therefore be named explicitly.
Extracting permission without burden#
Someone may cite catastrophic override while omitting the extraordinary evidential and necessity conditions attached to it.
That is not an application of the framework.
Using species-neutrality to rank vulnerable humans politically#
The marginal-cases argument concerns moral ontology under carefully stipulated conflicts.
It does not automatically authorize institutions to classify real humans into tiers of legal worth while ignoring epistemic error, discrimination and systemic consequences.
Using stewardship as a blank cheque for ecological engineering#
Ethical Sapiens permits the possibility of future stewardship.
It does not grant humanity a presumption that it currently understands complex systems well enough to redesign them.
Using inaction risk to justify reckless action#
The fact that inaction has consequences does not eliminate the burden carried by intervention.
Two-sided precaution means comparing risks, not privileging intervention.
Using uncertainty to escape responsibility#
An actor cannot call a problem genuinely indeterminate merely because further investigation is inconvenient.
Using "best available evidence" to excuse deliberate ignorance#
An agent cannot degrade the evidence base and then cite its weakness as protection from responsibility.
Using promised repair as justification for irreparable risk#
Repair duties do not demonstrate recoverability.
Treating derived conclusions as dogma#
Veganism, stewardship policies, AI precautions and institutional rules are conclusions of the framework, not sacred axioms immune to evidence.
Turning the moral court into authority over another person's body#
The court is a discipline for justification, not a committee entitled to demand disclosure, delay care or control another person's body. An institution proposing coercion carries its own burden concerning evidence, proportionality, error, legitimacy, unequal effects and less restrictive alternatives. A personal moral judgment does not silently become an enforceable claim.
Any interpretation that extracts a permission while discarding the burden, uncertainty, governance, proportionality or corrigibility conditions attached to that permission is not an application of Ethical Sapiens but a truncation of it.
The goal is not to make misuse impossible.
That would require removing almost all substantive content.
The goal is to ensure that remaining risk comes from openly defended commitments rather than preventable ambiguity.
Section 82
The deepest epistemic limitation#
No moral agent can prove that every consequence has been considered.
There will always be unknown unknowns.
Every model compresses reality.
Every civilization possesses cognitive limits.
Ethical Sapiens cannot promise perfect outcomes.
Its ambition is different:
to make moral decisions increasingly worthy of trust.
That requires:
- compassion
- curiosity
- serious evidence
- attempts to falsify preferred conclusions
- independent criticism
- institutional safeguards
- and humility regarding residual uncertainty.
At some point action nevertheless becomes necessary.
A civilization waiting forever for certainty can be as irresponsible as one acting recklessly without evidence.
Thus:
When further uncertainty cannot reasonably be reduced, when additional inquiry has diminishing expected moral value after structural uncertainty has itself been considered, when delay carries substantial moral cost, and when the decision process has earned sufficient epistemic trust, action may be justified even though error remains possible.
Acting despite uncertainty is not necessarily the opposite of humility.
Sometimes it is what humility looks like after acknowledging that certainty is unavailable.
Section 83
A civilization capable of saying "we were wrong"#
Perhaps one of the clearest measures of moral development is not the absence of error.
A sufficiently active civilization will make mistakes.
A more meaningful measure may be whether it can recognize them.
Whether inconvenient evidence is rewarded or suppressed.
Whether victims are acknowledged.
Whether failed models are preserved.
Whether institutions change when their justification collapses.
Whether powerful beneficiaries accept better alternatives when those alternatives threaten them.
A corrigible civilization should be capable of saying:
We believed this was right.
The evidence changed.
We were wrong.
We caused harm.
We will stop what we can.
We will repair what can be repaired.
We will change the process that allowed us to miss it.
That may mark part of the difference between intelligence and wisdom.
Section 84
From Homo sapiens to Ethical Sapiens#
Homo sapiens is commonly rendered as the wise human.
Humanity has demonstrated extraordinary intelligence.
Whether we have demonstrated comparable wisdom is less clear.
A species capable of nuclear weapons, genome editing, artificial intelligence and planetary ecological transformation can remain morally immature.
The transformation imagined by Ethical Sapiens is therefore not primarily biological.
It is moral, scientific, institutional and cultural.
From intelligence serving power
toward intelligence constrained by responsibility.
From inherited exploitation
toward justification.
From familiar moral circles
toward sentient consideration.
From permanent assumptions of necessity
toward better alternatives.
From good intentions
toward earned epistemic trust.
From fear of mistakes
toward responsible action under irreducible uncertainty.
From merely correcting beliefs
toward repairing harm.
From dominion
toward stewardship.
Section 85
Returning to Ivan#
Ivan Karamazov's rebellion need not be answered by proving that suffering is secretly necessary for a perfect universe.
Perhaps there is no cosmic explanation that makes every terrible event acceptable.
Perhaps an animal being eaten alive is simply undergoing something terrible.
Perhaps the suffering of a child is not redeemed by some future metaphysical harmony.
Ethical Sapiens begins by refusing to erase the victim inside the abstraction.
The questions become:
What happened to this subject?
Can we understand why?
Could it have been prevented?
What would prevention cost others?
What interests conflict?
Do we know enough to act?
If we do not, can we learn?
If we act and discover we were wrong, can we stop?
Can we repair?
No cosmic guarantee is required.
The universe does not need to already be just for sentient beings to create pockets of justice within it.
Section 86
Responsibility#
We are not gods.
We are not outside nature.
We are fallible sentient animals whose technological capability has grown faster than our ability to understand every consequence of its use.
That capability has enabled extraordinary suffering.
It has also enabled us to prevent forms of suffering that earlier organisms were powerless against.
The question is therefore not whether humanity should possess power.
Power already exists.
The question is what should constrain it.
Not domination because we can.
Not paralysis because certainty is impossible.
Not exploitation because tradition calls it normal.
Not inaction because suffering is natural.
Not intervention merely because compassion makes us feel righteous.
But responsibility.
Through sentient life, physical reality produced beings capable of experiencing good and bad.
Through intelligence, some became capable of recognizing related experiences in others.
Through science, they became capable of understanding some of their causes.
Through technology, they became capable of changing some of them.
Through compassion, they can want better outcomes.
Through reason, they can question whether compassion is enough.
Through criticism, they can discover that they are wrong.
Through institutions, they can constrain their own power.
Through corrigibility, they can change.
And through responsibility, they can attempt something blind natural processes had never previously attempted deliberately:
to understand which forms of suffering need not continue, to protect the subjects for whom existence can go well or badly, and to create better alternatives without forgetting that the attempted cure can itself become the harm.
The universe does not need to contain a pre-existing moral plan.
It contains beings capable of making plans.

What those agents do with that possibility is not predetermined.
